Terms of Service

These terms apply to your use of the Payflo website, point of sale software, hardware and related services (together, the "Services") provided by Payflo Pty Ltd (ABN 55 677 217 177) ("Payflo", "we", "us", "our"). By using the Services you agree to these terms. If you use the Services on behalf of a business, you confirm you are authorised to bind that business.

1. The Services

Payflo provides POS software, payments and related tools for hospitality and retail venues, including features such as ordering, kitchen display, billing, reporting and integrations. Features available to you depend on the plan you choose. We may improve, change or discontinue features from time to time.

2. Your account

You must provide accurate information when you sign up and keep your login details secure. You are responsible for activity under your account, including by your staff. Tell us promptly if you suspect unauthorised use.

3. Free trial, plans and fees

We offer a free 30-day trial and a range of plans, with current pricing shown on our Plans page. There are no lock-in contracts: you can cancel your plan at any time and the cancellation takes effect at the end of your current billing period. Fees are charged in Australian dollars and, unless stated otherwise, are exclusive of GST. Payment is due when invoiced or charged to your nominated payment method. If a payment fails we may suspend the affected Services until it is resolved.

4. Hardware

Hardware is sold to you outright at the price shown at the time of purchase, with no terminal rental fees. Ownership passes to you on payment in full. Hardware warranty and returns are handled in accordance with your rights under the Australian Consumer Law and any warranty terms provided with the product.

5. Payments

Payment processing is provided through our payment and banking partners, and merchant rates are agreed with you in advance. Your use of payment processing may also be subject to the terms of those partners. You are responsible for complying with card scheme rules and applicable laws when taking payments.

6. Your data

You own the data you put into the Services, including your menus, sales and customer information. You give us permission to process that data to provide the Services. You are responsible for making sure you have the right to collect and use that data, including any notices and consents required from your customers and staff. How we handle personal information is described in our Privacy Policy.

7. Acceptable use

You must not misuse the Services, including by attempting to gain unauthorised access, interfering with the Services or other users, using them for unlawful purposes, or reverse engineering or copying the software except as permitted by law.

8. Intellectual property

We and our licensors own the Payflo software, website, branding and content. We grant you a non-exclusive, non-transferable right to use the Services for your business while you have an active plan. Nothing in these terms transfers ownership of our intellectual property to you.

9. Support and availability

We provide support as described for your plan, with business-hours phone support on the Free plan and 24/7 support on Starter and Pro plans. We work to keep the Services available but do not guarantee that they will be uninterrupted or error free, and they may be unavailable from time to time due to maintenance or events outside our control, including internet, power or third-party outages.

10. Third-party services

The Services can connect to third-party products such as Xero, Uber Eats and Deliverect. Those services are provided by their owners under their own terms, and we are not responsible for them.

11. Our responsibility to you

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or other law that cannot be excluded. Subject to that, to the extent the law allows, we are not liable for indirect or consequential loss, or for loss of profit, revenue or data, and our total liability for any claim relating to the Services is limited to the fees you paid us in the 12 months before the claim arose or, for goods, to repairing or replacing them or paying the cost of doing so.

12. Suspension and termination

You may stop using the Services and cancel your plan at any time. We may suspend or end your access if you breach these terms, if fees are overdue, or where needed to protect the Services or other users. On termination you can request an export of your data within a reasonable period, after which we may delete it in line with our Privacy Policy.

13. Changes to these terms

We may update these terms from time to time. The latest version will be on this page with its date, and continued use of the Services after a change means you accept the updated terms. For material changes we will give you reasonable notice.

14. Governing law

These terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of New South Wales.
